Acceptable Use Policy
This Acceptable Use Policy ("AUP") governs your use of the Yapper platform and is incorporated into the Terms of Service. Violations of this AUP may result in suspension or termination of your account.
1. Messaging Conduct
You must not use the Service to send or facilitate:
- Spam or unsolicited messages — bulk messages to recipients who have not opted in, or messages that violate WhatsApp's Business Messaging Policy.
- Deceptive content — messages that mislead recipients about the sender's identity, the nature of the communication, or the involvement of AI in generating replies.
- Harassment or threats — messages that harass, intimidate, threaten, or promote violence against any individual or group.
- Hate speech — content that promotes discrimination or hatred based on race, ethnicity, national origin, religion, gender, sexual orientation, disability, or any other protected characteristic.
- Illegal content — messages that promote, facilitate, or relate to illegal activities, including fraud, money laundering, drug trafficking, or the sale of prohibited goods.
- Adult or explicit content — sexually explicit material or content inappropriate for general audiences.
2. AI Use Requirements
When using Yapper's AI-powered messaging features, you must:
- Disclose AI involvement — inform your end users that they may be communicating with an AI-powered system, as required by applicable law and WhatsApp's policies.
- Supervise AI output — review and monitor AI-generated messages to ensure they are accurate, appropriate, and consistent with your business standards.
- Configure responsibly — set up prompts, examples, and instructions in a manner that does not encourage the AI to generate harmful, misleading, or illegal content.
- Provide escalation paths — maintain a way for end users to reach a human representative when needed.
3. WhatsApp Compliance
The Service operates through the WhatsApp Business API. You are responsible for complying with all applicable WhatsApp and Meta policies, including:
This includes compliance with WhatsApp's prohibited business categories and industry restrictions as defined in their policies. Violations of WhatsApp's policies may result in Meta restricting or disabling your WhatsApp Business Account, which is outside of Yapper's control.
4. Data Protection
You must not use the Service to:
- Collect or process personal data without a lawful basis or without providing required notices to Data Subjects.
- Process sensitive personal data (health, financial, biometric, etc.) through the Service unless you have obtained explicit consent and have appropriate safeguards in place.
- Transfer personal data to jurisdictions that do not provide adequate data protection without implementing appropriate transfer mechanisms.
- Retain end-user data beyond the period necessary for your stated business purpose.
5. System Integrity
You must not:
- Attempt to gain unauthorized access to the Service, other accounts, computer systems, or networks connected to the Service.
- Reverse-engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Service.
- Introduce viruses, malware, or any other harmful code into the Service.
- Use automated tools (bots, scrapers, crawlers) to access the Service in a manner that exceeds normal usage or degrades performance.
- Circumvent rate limits, authentication mechanisms, or other security measures.
- Resell, sublicense, or provide access to the Service to third parties without our prior written consent.
6. Regulatory Compliance
You are responsible for ensuring your use of the Service complies with all applicable laws and regulations, including but not limited to:
- Anti-spam laws (CAN-SPAM, CASL, applicable local laws).
- Data protection laws (GDPR, CCPA/CPRA, LFPDPPP).
- Consumer protection laws (FTC Act, PROFECO regulations).
- Telecommunications regulations applicable to messaging services.
- Industry-specific regulations that apply to your business (e.g., healthcare, financial services).
7. Account Responsibility
You are responsible for the actions of all users you authorize to access your account. You must ensure that all authorized users are aware of and comply with this AUP. Account Owners are liable for violations committed by their authorized users.
8. Reporting Violations
You must promptly report any violation of this AUP that you become aware of — whether by your own users, end users, or other parties — to abuse@yapper.vip. You agree to cooperate with us in investigating and remedying any such violation, including by providing information and access reasonably requested by Yapper.
9. Enforcement
We may investigate suspected violations of this AUP. If we determine that a violation has occurred, we may take any of the following actions at our discretion:
- Issue a warning requesting immediate corrective action.
- Temporarily suspend the offending account or feature.
- Permanently terminate the account.
- Report the activity to law enforcement if required by law or if the violation involves illegal activity.
Where practicable, we will provide notice before taking enforcement action, except where immediate action is necessary to protect the Service, other users, or comply with legal obligations.
10. Changes to This Policy
We may update this AUP from time to time. Material changes will be posted on this page with an updated "Last updated" date. Continued use of the Service after changes are posted constitutes acceptance of the revised AUP.
